State Aid - EU vs India:
In India, the Courts / Competition Law Regulator i.e. Competition Commission of India (CCI) does not have the power to question the policy matters of the Central Government. Therefore, unlike European competition law, the Indian competition law regime does not provide for state aid rules.
In case the Indian Government revokes an Advance Pricing Agreement (APA) entered into with an MNC, in principle, the doctrine of Promissory Estoppel can be invoked against the Government for withdrawing the benefit as per agreed terms.
