As AI continues to evolve, its impact on the workplace is profound, presenting both opportunities and challenges. One of the most pressing challenges is the responsible use of software and algorithms used in hiring. Such technology, if not properly used, can perpetuate bias and discrimination in the hiring and evaluation process. The lack of transparency in AI decision-making processes, often referred to as the "black box" problem, can lead to unfair treatment and legal disputes. When litigation ensues, who, then, is liable to employees claiming discrimination? Is it the employer who purchased the software? The software developer? Both? Neither? This panel will examine the opportunities and challenges raised by the use of software and algorithms in employment, and particularly in hiring, and how courts are grappling with the question of liability when discrimination occurs.
