The 2011 UN Guiding Principles on Business and Human Rights underlined that “the risk of gross human rights abuses is heightened in conflict-affected areas.” Companies operating in these areas are expected to exercise enhanced due diligence, including ensuring that they do not commit violations of international humanitarian law. Various conflict situations have highlighted the difficulties faced by companies when deciding what to do: to continue operating in the country under certain conditions, or cease their activities? Similar dilemmas arise for businesses operating in high-risk countries. The round table will examine the companies’ obligations in this regard, the legal risks incurred by them, as well as the means available to help them meet such obligations.
