Arbitration and Insolvency
The panel will discuss the interactions between arbitration and insolvency proceedings and the impact that the insolvency of one of the parties can have on an arbitration. In this panel we will also address the issue of interim measures and its interaction with insolvency. This topic is particularly relevant considering the increase in insolvency proceedings derived from the pandemic and the economic crisis.
Recent Developments in International Arbitration
The purpose of this panel will be to discuss the modifications to the Energy Charter Treaty, in particular those that: (i) intend to reduce protection for investors in fossil fuels; and (ii) entail the exclusion of intra-EU claims. In addition, this would be a good opportunity to analyse (from an international perspective) topics such as interim measures, the duty of disclosure for arbitrators or applicable law, which have recently been included in the newly approved reform of the Italian Arbitration Law.
