International Family Law: New Challenges
The international processing of cases involves new challenges every year. Domestic changes in each jurisdiction have a direct impact on cross-border cases, which implies the necessity of constant updates. In this session we will discuss the “forum shopping”: the possibilities of choosing a particular jurisdiction for divorce cases with an international component; the evolution of domestic regulations to address domestic violence cases, and whether these changes are really achieving the goal of reducing the phenomenon of violence; the different systems of enforcement of foreign orders and/or judgments and the compatibility between them; and finally we will reflect on procedural good faith and its implications in each jurisdiction, in order to fully understand the correct rules of the game in each case.
