Compliance in the service of investment in OHADA law: challenges, issues and perspectives
Africa is the continent of all paradoxes. The most encouraging prospects for economic growth, particularly in the post-Covid context and despite the Ukrainian crisis, come with the most alarming figures in terms of corruption and illicit financial flows. Corruption and therefore non-compliance with standards, at all levels of economic life, is unanimously recognized as one of the major obstacles to investment and the emergence of the African economy.
In order to contribute to the development of possible solutions to this scourge, on the one hand, and to improving the efficiency of OHADA’s normative corpus on the other hand, in terms of its aim of attracting and protecting investment, it has been proposed that the first session – both analytical and prospective – be organized on the subject of compliance in the service of investment in OHADA law (Organization for the Harmonization of Business Law in Africa). The session aims at analyzing the evolution of OHADA's material rules and comparing them with compliance-related requirements in the particular context of investment, in order to assess their accuracy and appropriateness in this context. This involves organizing discussions between practitioners, with the contribution of experiences from businesses and administrations.
