This panel will focus on lawyers and the issues that ADR presents in their professional practice. Cezary and Agnieszka will describe how mediation and collaborative practice fit within the legal practice and why legal representatives refer the cases to mediation instead of court proceedings. Johannes will share the results of a survey carried out by the University of Antwerp and Conflicool on the behavior of litigants when faced with a conflict. Gérard will analyze the cognitive biases that limit the recommendation of mediation by lawyers and Fabienne will summarize the reform projects of the French code of civil procedure and point out potential consequences on lawyers’ expected practice.
